Johannesburg marvels at rare snowfall

Snow flurries blew through South Africa on Tuesday, closing several border crossings with Lesotho and dusting parts of the country in white as residents poured into the streets to watch the snowflakes fall.

"It's amazing, Merry Christmas!" said Roger Gibbs, driving through a leafy suburb in commercial hub Johannesburg where the trees were frosted in white -- the first time in five years.

Snow falls annually in the mountains of South Africa and Lesotho, which even hosts a ski resort. But some high-altitude border posts between the countries received so much snow Tuesday that they were forced to close.

Heavier snowfall in the Western mountains closed the main highway linking Johannesburg to Durban, Africa's busiest port, for several hours.

The snowfall swept north across Johannesburg, coating southern neighbourhoods in the early morning and then moving toward the Sandton financial district.

"Amazing! Never happened in my life," said Mizundile Eseu, 23, a security guard.

The South African Weather Service said six of the country's nine provinces had snowflakes on Tuesday, with snow expected through the night in Johannesburg.

Authorities urged motorists to take care on the roads, with few drivers used to travelling on snowy streets, but no accidents had been blamed on the snow, according to police.

Smooth-Talking Hacker Remote-Wipes Reporter's iPad, MacBook

We've heard it before: Make sure to secure your online accounts with a strong, distinct password to avoid being hacked. But what if hackers can simply circumvent the need for your password to gain access to your information?

That's what happened to reporter Mat Honan when Apple tech support gave a hacker access to Honan's iCloud account, wreaking havoc on the Wired reporter's digital life.

Late Friday, hackers gained access to Honan's iCloud account. From there, they were able to access his Gmail account, Twitter account and the Twitter account of his former employee Gizmodo. In his blog, Honan recounted the speed of the attack:

At 5:00 PM, they remote wiped my iPhone At 5:01 PM, they remote wiped my iPad At 5:05, they remote wiped my MacBook Air.

Even scarier, because Honan's password was bypassed, his password strength -- he used a seven digit alphanumeric password -- and reliance on software like 1Password did him no good.

After a nightmare ordeal trying to regain control of his accounts, Honan was contacted by someone claiming to be his hacker. After some digging, Honan says it was Apple support that mistakenly gave the hacker access to his iCloud account.

"I know how it was done now. Confirmed with both the hacker and Apple. It wasn't password related," Honan wrote in the latest update on his blog. "They got in via Apple tech support and some clever social engineering that let them bypass security questions."

Honan's Twitter and Gmail service has been restored and he is working to recover what data he can from his machines. However, it's still unclear what "clever social engineering" his hacker used to avoid answering security questions. Honan has been responding to questions on his Twitter feed about the experience and says he is giving Apple a chance to respond before giving more details of the attack.

Without a Remedy, Your Lease or Other Contract May Mean Nothing ...

Having contract rights is ?pretty neat,? but without any remedy if those rights aren?t fulfilled, they are just empty promises. So, when the other party breaches your agreement and doesn?t deliver what you bargained for and you can?t ?work it out? between the two of you, you?ve got to ?ask the judge (or an arbitrator, if that?s what you?ve agreed to do)? to step in and give you a remedy for this breach. In such a case, what can you expect?

Given that it is unusual for contracting parties to go to court, one might think that having a well-grounded knowledge of the kinds of damages that are or are not available in a given situation isn?t very important. That would be a mistake because one of the factors driving contract compliance is the ?fear? of the need to pay damages or to be legally compelled to comply. If parties could breach their agreements without adverse consequence, our commercial system would break down. A contracting party is always in the position of weighing the cost of delivering promised performance against the cost (damages) of non-performance.

This is a very big topic even after cutting it to the core. So, expect our treatment of this subject to be spread out in four installments. The first three will be somewhat academic, but hopefully easy to read and digest. The last installment will attempt to work through the remedies that a landlord may have against a defaulting tenant. It is our intention to spread the four installments over seven weeks, allowing Ruminations to mix in some other topics of applied practice. Unless distracted by unrelated events, next week?s edition will explore post-sale and post-lease commencement date environmental responsibilities of the parties.

To repeat, our overall topic for this series is about ?remedies,? an important subset of which is ?damages.? This isn?t going to be a law review article. In fact, we?re going to put the ?mumbo jumbo? at the end of the third installment for those brave readers who are compelled to ?read on.? Also, you?ve heard this caveat before ? it is even at the bottom of the web page ? ?no one should mistake anything written on this blog as resembling legal advice, even when written by an attorney ? not the original blog entries, and not any comments.?

There are two kinds of remedies available to an aggrieved party: (a) those remedies that can make someone do what they should have done on their own or stop them from doing what they shouldn?t be doing; and (b) those remedies that try to make the aggrieved ?whole,? that is, get compensated for its losses.? In the case of a contract, like a lease, losses include the benefits it expected, but didn?t get.

We?re going to give short shrift to equitable remedies such as various injunctions and specific performance. You can see some thoughts way down below. Similarly, we?ll say (very) little about declaratory judgments (a statutory remedy), and that will also be near the bottom. While you?re searching near the bottom of this posting, you?ll also find some contract remedies that are ?equitable? in nature, such as rescission and reformation.

The real action is in contractual money damages. Most are designed to put the aggrieved (generally, non-breaching) party where it should have been absent the other party?s default. If you want to know about ?tort? damages, you?ll need to find a blog site other than Ruminations.

If all that granting contractual money damages did was to make someone ?whole,? then these damages wouldn?t be characterized as ?General,? or ?Special? or ?Liquidated? because it wouldn?t make a difference as to ?how your lease or other contract described them. And, there wouldn?t be subcategories such as ?actual or compensatory damages,? ?consequential damages,? ?exemplary or presumptive or punitive damages,? ?incidental damages? (which we aren?t going to define), or the myriad of other terms that courts and commentators (or even laypersons) throw around.

This is important because you often see a lease or other contract say things like: ?Notwithstanding anything to the contrary set forth in this Lease, neither party shall ever be liable to the other for consequential, indirect or punitive damages arising out of any breach or default of this Lease, including, without limitation, loss of use or income from the Shopping Center or the Premises or any equipment or facilities therein and each party waives, to the extent permitted by law, any and all claims for such damages.? How many of us actually know what is being given up or gained?

So, what Ruminations will try to do is to define some of these terms and, in some cases, add a little commentary. Here we go.

The place to start is with compensatory damages, not restitutionary damages. OK, we?ll explain ?restitutionary? later, but you won?t miss anything before we get there.

Now, we?re going to reveal a big secret about the whole judicial treatment of ?Damages.?? Courts are all over the place when it comes to definitions. The main source of confusion is that some of the definitions change depending on whether you are looking a tort or at a contract breach.

In the case of a tort (think of those as ?civil? wrongs, rather than wrongs arising out of a contract), compensatory damages can be either ?General? or ?Special.? Plainly speaking, the distinction between those damages is that every finder of fact (think, jury) can figure out General damages, like pain and suffering or how much someone gets for disfigurement (there really isn?t a calculation that can be made), but while Special damages also arise out of the ?wrong,? you need to specifically prove them (and, in a lot of cases, plead them, but that?s litigation stuff, and Ruminations doesn?t do windows, floors or litigation).

When talking about the remedies a party has when harmed by a breach of contract, ?Special Damages? takes on a different meaning. In contract cases, courts treat ?General? damages as the ?opposite? of ?Consequential Damages.?? That would mean that ?Special Damages? are not opposite of ?Consequential Damages.? More plainly speaking, when you are talking ?contract,? there isn?t much of, if any, distinction between Special Damages and Consequential Damages. To Ruminations, ?Natural Damages? might be a more accurate ?opposite? of ?Consequential Damages? than ?General Damages,? and we?d do away with ?Special? altogether.

So, here is drafting tip number one: If you agree to waive ?Special? damages, make sure you understand what you are giving up. If what you intend to exclude are damages that arise out of the breach because they are too remote or unexpected, then all you need to waive are ?Consequential Damages.? If you say both ?Special? and ?Consequential,? a court might want to give ?extra? meaning to the word ?Special,? and in doing so it might conclude that you are waiving any (tort) damages that would need to be proven such as ?how much it reasonably and actually cost you to get something fixed that the other party was supposed to fix.? You see, for a tort, that?s not a ?General? damage because a finder of fact doesn?t have it in her or his ?general? experience to know how much it cost to fix your building?s particular roof. ?It is a ?Special? damage because you have to prove to the finder of fact how you came up with the dollar amount you are claiming. If you don?t know what ?Special? damages are, you might think there was something ?really? special about them. There isn?t. Waiving them probably might not sound so innocuous any more.

We?re going to stop here, and if our plans remain undisturbed, Ruminations will return in two weeks with the next installment, starting off with the topic of consequential damages.

(AP) ? Syrian forces threatened Sunday to mount a "decisive battle" for Aleppo even as rebels clawed toward the city's ancient center under intense bombardment and strafing from warplanes. In the capital Damascus, militiamen appeared to step up guerrilla-like forays in central districts that were once firmly in the regime's hands.

The twin fronts reflected the rising stakes for both sides and a possible significant evolution in rebel strategies. Opposition forces appear to be shifting toward more hit-and-run strikes in Damascus and elsewhere to tie up Bashar Assad's forces and blur the lines between rebel and government-held territory.

The biggest prize of the ambush brigades so far ? 48 abducted Iranians branded as spies by rebels ? was put on display in a video that carried a warning that all Iranians in Syria would be "captured or killed" because of Tehran's strong backing for Assad. Iran said those captured when their bus was commandeered on Saturday were pilgrims visiting an important Shiite shrine on the outskirts of Damascus.

The abductions threaten to suck Iran deeper into Syria's civil war and the wider political brinksmanship around the region. Iran claims it has no fighting forces aiding Assad, but it has sharply amplified its criticism of countries supporting the rebels such as neighboring Turkey and Gulf states led by Qatar and Saudi Arabia.

In further signs of the growing proxy nature of Syria's conflict, Iran was forced to reach out to Turkey and Qatar with appeals to help return the captives.

The daylight hijacking on the main airport road in Damascus also raises questions about the regime's ability to control key parts of the capital and protect the symbols of Assad's power such as ministries and government offices? already breached once by a bombing last month that killed four members of Assad's inner circle including his brother-in-law and the defense minister.

The pro-government Al Watan newspaper said the Syrian army is bracing itself for a "decisive battle" to clear Aleppo, Syria's largest city, from rebels. It gave no possible timetable and for more than a week, activists have claimed the government is gearing up for an all-out offensive on the northern commercial center ? another critical battleground for Assad's regime to survive.

Government gunners pounded rebel-held areas to keep militiamen from expanding their hold on the city center, dominated by a medieval castle whose loss would be a deep symbolic blow for Assad. Local activist Mohammad Saeed said government warplanes joined in the attack by strafing rebel positions.

"Fighter jets to us are now as common as birds in the sky," Saeed said.

Saeed and the British-based Syrian Observatory for Human Rights reported heavy shelling and clashes mainly in districts flanking Aleppo's historic center: Salaheddine to the southwest and al-Sukkari and Hananou to the northeast. An amateur video posted on the Internet claimed to show shells crashing into a narrow street in Salaheddine, sending a shower of glass shards and chunks of rubble. The authenticity of the video could not be independently verified.

It's clear, however, that Assad's troops cannot simply surrender parts of Aleppo ? a city of 3 million ? to rebels without exhausting all military means. Rebels also have managed to keep open supply corridors from the Turkish border, about 25 miles (40 kilometers) away, which could also be targeted by any government ground offensive.

Syria's official news agency SANA described the Aleppo rebels as "Gulf and Turkish militias" ? more evidence of the deep regional fissures between Assad and allies such as Iran on one side and nations that back the rebels on the other.

The government also claimed it had regained full authority over Damascus after driving out rebels from central districts including near Abbassiyyin Square, a major roundabout. But residents reported loud explosions and gunfire echoing from several areas of the capital overnight and early Sunday.

Khaled al-Shami, an activist in Damascus, dismissed as "nonsense" the official reports that rebels were pushed from Damascus. He said rebels are increasingly using a tactic of quick-hit attacks to frustrate security forces and keep the capital unstable.

"The Free Syrian Army does not seek to hold territory in Damascus but rather stage hit-and-run attacks that drain the regime. The rebels are present and strong there," he said.

U.S. Secretary of State Hillary Rodham Clinton plans to visit Istanbul later this week for talks with Turkish officials over the worsening crisis in Syria, the State Department said Sunday. Turkey has taken in tens of thousands of Syrian refugees and hosts some high-profile defectors from Assad's regime.

Turkey's state-run agency said Syria's first man in space has fled to Turkey and joined opposition forces. The Anadolu agency said Mohammed Ahmed Faris crossed into Turkey after reaching Aleppo.

Anadolu said it was Faris' fourth attempt to defect. The agency gave no other details on his escape and provided no source for the report. Faris, who was born in Aleppo in 1951, was part of a three-man crew of a Soviet space mission in 1987.

Turkey also has been drawn into the showdown over the Iranian captives with Tehran's appeal for intervention.

A video broadcast by the pan-Arab network Al-Arabiya purported to show Syrian rebels guarding a group of Iranians. Armed men in the video identify themselves as members of the rebel "Baraa Brigades" and say that at least one of the 48 captives was an officer of Iran's powerful Revolutionary Guards. They show what they say is his ID and a permit to carry weapons.

The captors claim the Iranians were on a "reconnaissance mission" in Damascus at the time they were abducted. Iran says they are pilgrims who were visiting a shrine to the granddaughter of the Prophet Muhammad.

"We promise Iran and all those who support this regime ... we will strike at all (Iranian) targets in Syria," one of the rebels says in the video. "The fate of all Iranians who operate in Syria will be the same as those we have here, either captive or killed, God willing."

In Tehran, a senior member of an influential parliamentary committee advised Iranians against traveling to Syria, state-run Press TV reported, in a high-ranking acknowledgment that Syrian rebels have expanded their hold over key roads and other areas once firmly under Assad's control. The comment by Kazem Jalali, a member of Iran's Committee on Security and Foreign Policy, does not represent an official Iranian discouraging travel to Syria, but the views of the parliament group often shape policies.
