LOS ANGELES (AP) ? More than a year after a San Francisco Giants fan was brutally beaten at Los Angeles' Dodger Stadium, a judge is hearing evidence to determine if two suspects should be tried for a crime that stunned both cities.

On Wednesday, Superior Court Judge George Lomeli watched a videotape of one defendant admitting involvement in the attack in a phone call to his mother.

When the preliminary hearing resumes Thursday, prosecutors plan to present details of the beating on opening day 2011 that left paramedic Bryan Stow severely disabled and still undergoing rehabilitation therapy.

The case is fraught with undercurrents for the city where Dodger Stadium has long been the central baseball landmark. The beating prompted public outrage and led to increased security at Dodgers games.

Lawyers for defendants Louie Sanchez and Marvin Norwood suggested in cross-examination they might have been involved in some other altercations at the stadium that day.

In the videotape played in court, Norwood told his mother that he was involved and expected to "go down" for the attack.

"Mom, you good?" Norwood says on the phone borrowed from one of the detectives. "You sure? Hey, I got arrested for that Dodger Stadium thing."

After a brief pause, he adds, "I was involved. I was. To a certain extent I was."

Moments later, he says, "I will very certainly go down for it."

In the recording, Norwood mentions the name of his co-defendant, Louie Sanchez. His last words on the conversation were, "I'm sorry."

The judge will determine if there is enough evidence for Norwood and Sanchez to stand trial on charges of mayhem, assault and battery, and inflicting great bodily injury. Both have pleaded not guilty.

The detective who interviewed Norwood on July 21, 2011, testified about the conversation.

Howard Jackson said Norwood told him at one point that there were a number of fights in the parking lot and that Norwood didn't think he was involved in the Stowe incident.

However, Jackson said Norwood told him he saw blood after Sanchez punched a Giants fan.

Two more witnesses who attended the March 31, 2011, game told of being bothered by Sanchez, who was throwing peanuts and spraying soda on a woman in the bleachers.

Pictures that witness Marc Lu took from his seat were projected on a large screen clearly showed Sanchez sitting next to Lu's group. At the end of the game, Sanchez sprayed a bottle of soda, said Lu, who was wearing a Giants T-shirt at the game.

"We were kind of staring at him in disbelief. He was facing us, kind of staring us down, looked like he was ready to fight." said Lu, who said Norwood was with Sanchez.

Prosecutors called five more witnesses who had seats near Sanchez and Norwood at the game. They told of the peanut-pelting and said Sanchez was drunk and dousing Giants fans with soda.

Some of the witnesses said they intervened to keep a fight from breaking out in the bleachers.

Kathryn Gillespie, who was hit with peanuts and drenched with soda, said she held her boyfriend back when a confrontation with Sanchez appeared imminent. She is named as a victim of battery in the complaint.

"We just wanted to leave the situation and get out of there safely," she said.

"And is that what you did?" asked Deputy District Attorney Beth Silverman.

"Yes," said Gillespie. "Finally we just went in our own direction and never looked back."

The new FiOS Internet portfolio will feature download/upload speeds of 50 Mbps/25Mbps and 150Mbps/65Mbps and two new tiers of 75Mbps/35Mbps and 300Mbps/65Mbps.

The new speeds will be offered in stand-alone and bundled packages and are designed to address the growth of bandwidth-intensive applications and the increase in the number of Internet-connected devices being used simultaneously in the same household.
In a statement, Verizon said the new speeds will also support consumers who are watching more over-the-top video programming on TVs and portable devices, and accommodate the rise in Internet-enabled applications like video and audio streaming, home monitoring devices, video chat, multiplayer gaming and online backup services.
?The ways we used the Internet and watched TV over the past 10 to 15 years have dramatically shifted,? said Verizon?s consumer and mass market business unit president Bob Mudge in a statement. ?With the emergence of smartphones, smart TVs, Blu-ray players, tablets and gaming consoles that also serve as over-the-top devices, consumers need more bandwidth to receive the highest-quality experience.?
In a statement, Verizon said that the 75Mbps/35Mbps service is geared toward households that downlooad HD movies, participates in multi-player gaming and has three or more interconnected users. The highest tiers (150Mbps and 300Mbps) are targeted at households of five or more interconnected users that want to download high-quality HD video on multiple devices.
For example, with a 300 Mbps connection, consumers can download a two-hour, standard-definition movie (1.5 gigabytes) in less than 40 seconds; and a two-hour, high-definition movie (5 GB) in 2.2 minutes. On a 150 Mbps connection, the same two-hour, SD movie can be downloaded in less than 80 seconds, and the two-hour, HD movie in less than 4 ? minutes.
?High-speed Internet no longer is just for techies, as more than half of our residential consumers already use at least a 20 Mbps Internet connection,? said Verizon?s consumer and mass market business unit chief marketing officer Mike Ritter in a statement. ?Streaming online video on an all-fiber-optic connection providing faster speeds is better and more reliable during peak Internet usage hours.
?As recently as 2005, video was less than 10 percent of Web traffic,? said Ritter. ?By the end of this year, we expect it to be 50 percent, growing to 90 percent in just a few years.?
Verizon estimated that today, the average home has seven Internet-connected devices, growing to between 9 and 15 devices by 2015.
The top two tiers require customers to be connected via a GPON (gigabit passive optical network) terminal. For existing customers who have a BPON (broadband passive optical network) terminal and qualify for the GPON service, the installation of a new GPON terminal will be required.

A Rose by Any Other Name: International Crimes or Crimes Against ...

No matter what anyone may say, the names we give to concepts matter a great deal. They have an impact on the way we think about them. For example, in domestic American politics there is an ongoing debate over the value of the recent medical insurance overhaul. Those in favor of the modifications call it the ?Affordable Care Act?, while those who are against the changes call it ?Obama-care?. Both names apply to the exact same identical thing, but one brings forth a personal platform while the other implies a certain usefulness or characteristic. The name international law likewise has traditionally affected the way scholars and judges thought about the discipline. The name itself, ?inter-national?, implies that its rules apply to and among nations, or in modern terms, States.[1]

A terminology that started as a description of this branch of law has become its definition. This contributed to the assertion that ?inter-national? law does not apply or recognize, inter alia, individuals as subjects of the law.[2] While the exclusion of the individual as a subject of international law is still asserted by some, it is now commonly accepted that the individual is a subject of international law as the beneficiary of rights and assignments of duties in human rights law and international criminal law.[3] This has lead some to suggest that international law has evolved into something more akin to a global law.[4] My scope is much more modest in that I will focus on only one branch of international law. I would like to suggest that the time has come to reevaluate the name given to what we currently call ?international criminal law?. The basis for this reevaluation is two fold: (1) the name no longer reflects (if it ever truly did) the nature of the subject matter and (2) many national legal orders do not identify international crimes as ?international?, but rather have more nuanced names for the discipline. I will conclude by suggesting more accurate names to describe this discipline.

The first reason to discard the moniker of international criminal law relates to what the term itself means. As mentioned, the word ?inter-national? implies that the behavior or relationships to be regulated by this body of law occur between States. Criminal law, of course, references a body of law creating and punishing crimes. It is axiomatic that State crimes do not currently exist in modern international law. The International Law Commission?s Articles on State Responsibility do not include such a category of international violations even though such terminology was used in earlier drafts.[5] At the same time, international criminal tribunals do not have jurisdiction over States for the crimes within their jurisdiction even when those acts are attributable to a State.[6] The crimes themselves also do not envisage a State as the victim, but rather individuals or collectives of individuals.[7] Nothing about the perpetrator or the victim then is directly ?inter-national?.

The origin of international crimes, however, helps explain the terminology currently used in diplomatic and academic discourse. The first modern international criminal prosecutions took place at the end of the Second World War and were based primarily on violations of treaties.[8] Treaties, by definition, are ?inter-national? agreements.[9] The crimes were therefore acts in violation of ?inter-national? law. Additionally, the crimes were perpetrated in the context of a conflict between States and by individuals associated with one of the parties to that conflict and in furtherance thereof.[10] Neither of these conditions still holds in regards to modern international criminal law.

It is generally accepted that the laws of armed conflict criminalizing, inter alia, the mistreatment of protected persons, apply equally during ?inter-national? armed conflicts, intra-national armed conflicts and conflicts between two non-State groups within and between several States.[11] Under the last scenario, a conflict between two or more non-State groups, the consent of treaty law of a particular State is less relevant. Neither group necessarily has agreed to be bound by the laws of war. Consent however is not required because customary law criminalizes the behavior anyway. What we have under these conditions is a body of law that directly governs the acts of individuals working on behalf of non-State entities regardless of the consent or any specific State.

Outside of the arena of war crimes, it is also generally accepted that there is no need for State involvement for the commission of ?crimes against humanity?, an autonomous branch of international criminal law.[12] Groups that are unaffiliated with a particular State can set the widespread or systematic attack against a civilian population in motion that is necessary for their commission. Private individuals without the involvement of a State, likewise, can commit genocide.[13] These crimes therefore do not carry any link with States, let alone a connection to acts between States, to require the moniker of ?inter-national?.

As this brief description shows, the term ?inter-national? does not reflect the nature of the crimes under consideration. They do not necessarily relate to actions between States, but rather to certain acts that for one reason or another have been criminalized by the international community at the supranational level.

The second reason that reevaluating the name of ?international criminal law? is that the crimes normally associated with this name are often referred to under different names in national legal systems. I will list just a few here for the purpose of illustration. Cape Verde criminalized ?inter-national? crimes in a section of its penal code called ?Crimes Against the International Community?; Estonia refers to these crimes as ?Offenses Against Humanity and International Security?; France refers to them as ?Crimes Against Humanity and Against Persons?; Georgia calls them ?Crimes Against Humanity?; Guatemala calls them ?Crimes of International Transcendence?; and some former Soviet States refer to the crimes as ?Crimes Against Peace and Safety of Mankind?. There is little if any continuity between these terms and even less with the idea of ?inter-national? crimes.

The lack of any meaningful connection to the term ?inter-national? and the diversified practice of naming the same discipline within national legal systems both suggest that the name ?international criminal law? is on its way to being an anachronism if it is not already. There still remains the question of what the discipline should be called. One option would be to use the classic Latin phrase crimes hostis humani generis. Another option would be to invent a new term such as ?crimes against global order? or ?crimes of universal concern?. The better choice would be to adapt the term ?Crimes Against Humanity? to describe the entire field of law instead of a single subset of crimes. This has already been done implicitly by some of the national systems listed above. The sub-branch of the field now referred to as crimes against humanity can be referred to as ?human rights crimes? thereby further casting light on its relationship both to human rights law and its separation from war crimes and humanitarian law.[14] This kind of renaming scheme would better reflect the content of the law and its modern context.

Over the last 2-3 months filming this movie I?ve realized:

Complacency is an incredibly universal problem. We talked to dozens of people from all ages, races and backgrounds, and everyone had experienced it at some point in their lives. Most people experienced it multiple times.
Complacency is challenging to quantify. It?s vague ? there are these pop-culture phrases like ?keeping up with the Jones? or whatever that dance around the idea, but there aren?t a lot of books and movies that really point to this specific issue. That?s kind of good for us ? I mean, we have an opportunity to really tell this story and shine a light on this issue in a new way.
Most people who combat complacency have a specific ?AHA? moment. Not everyone, but many, many people we talked to ? they had a moment, a very specific question or event, that led them to change their thinking and move away from complacency.

Ex-Mubarak PM praises 'glorious' Egyptian uprising

CAIRO (AP) ? Egyptian presidential candidate Ahmed Shafiq paid tribute Saturday to the "glorious revolution" that toppled Hosni Mubarak, a dramatic turn-around for the former regime official who fought his way into the runoff elections by appealing to public disenchantment with last year's uprising.

Shafiq, the last prime minister to serve under Mubarak, vowed there would be no "recreation of the old regime" as he prepared to face off against Mohammed Morsi of the Muslim Brotherhood in a runoff on June 16-17.

"I am fed up with being labeled 'old regime,'" Shafiq told a news conference in his campaign headquarters. "This talk is no longer valid after seven million people voted for me." When pressed on the issue, he said: "All Egyptians are part of the old regime. Why do you keep saying the same thing over and over again?"

Shafiq and Morsi were the top vote-getters after a two-day election on Wednesday and Thursday which none of the 13 candidates could win outright. Now, both must appeal to the roughly 50 percent of voters who cast ballots for someone else.

Shafiq appeared to use the news conference to try and cast off his image as an anti-revolution candidate who spoke disparagingly about the youth groups that engineered the anti-Mubarak uprising, reaching out to all segments of society in a bid to rally voters who favored his rivals during the first-round.

A former air force commander and a personal friend of Mubarak's, Shafiq was booted out of office by a wave of street protests shortly after Mubarak stepped down on Feb. 11, 2011.

The 15 months since Mubarak's ouster have seen a surge in crime, a faltering economy and seemingly endless street protests, work stoppages and sit-ins. The disorder has fed disenchantment with the revolutionary groups, and may have played to Shafiq's advanatge.

However, ex-officer Shafiq is also associated with Egypt's military leadership. The generals who took over from Mubarak, say critics, have mismanaged the transitional period and failed to reform corrupt institutions or to provide security.

Furthermore, they are blamed for the death of more than a hundred protesters, torturing detainees and trying before military tribunals at least 12,000 civilians.

"I pledge to every Egyptian that there will be no turning back and no recreation of the old regime," said Shafiq, 70. "Egypt has changed and there will be no turning back the clock. We have had a glorious revolution. I pay tribute to this glorious revolution and pledge to be faithful to its call for justice and freedom."

Shafiq also tried to enlist the support of youth groups, singling out the large associations of soccer fans known as "ultras" and April 6, both of which played a key role in the uprising.

His outreach was swiftly rejected by April 6, whose spokesman Ahmed Maher told a news conference that his group will never talk to the former prime minister, whom it considers as a pillar of the Mubarak regime.

He paid special tribute to Hamdeen Sabahi, a socialist and a champion of the poor who finished in third place. He held out the possibility of naming him as his deputy if elected president.

Morsi's Brotherhood, meanwhile, has called for a meeting of the nation's political forces to "deal with the challenges facing the nation" ? a thinly veiled attempt to enlist support for its candidate.

More than a year after protesters demanding democracy toppled Mubarak, the face-off between the Morsi and Shafiq looked like a throwback to his era ? a rivalry between a military-rooted strongman promising a firm hand to ensure stability and Islamists vowing to implement religious law.

The head-to-head match between them is the most polarized outcome possible from the first round, and will likely lead to a heated campaign. Each has die-hard supporters but is also loathed by significant sectors of the population.

The first round race turned out close. By Friday evening, counts from stations around the country reported by the state news agency gave Morsi 25.3 percent and Shafiq 24.9 percent with less than 100,000 votes difference.

A large chunk of the vote ? more than 40 percent ? went to candidates who were seen as more in the spirit of the uprising that toppled Mubarak, that is neither from the Brotherhood nor from the so-called "feloul," or "remnants" of the old autocratic regime that Shafiq is considered one of.

In particular, those votes went to leftist Hamdeen Sabahi, who narrowly came in third in a surprisingly strong showing of 21.5 percent, and a moderate Islamist who broke with the Brotherhood, Abdel-Moneim Abolfotoh.

Bankia, Catalonia pile on Spanish debt worries

MADRID (Reuters) - Financial troubles at a big Spanish bank and one of the country's richest regions, Catalonia, piled on problems on Friday for the Madrid government and for investors who question whether it can pay its debts without help from euro zone allies.

Bankia SA, Spain's fourth biggest bank and newly nationalized, asked for a bailout of 19 billion euros ($24 billion) to repair losses from a property crash - the biggest Spanish bank rescue ever.

Meanwhile, the president of Catalonia, one of the wealthiest of Spain's 17 regions, said high interest rates demanded by wary creditors were making it hard for his administration in Barcelona to raise funds.

He called on the central government in Madrid to guarantee joint bonds issued by regional authorities or otherwise underwrite regional financing.

"We don't care how they do it," Artur Mas told reporters, saying the Spanish economy would not grow if the regions struggle to pay monthly bills to suppliers.

Investors believe the banks' capital shortfall and a credit crunch for regional governments could force the euro zone's fourth-largest economy to seek international aid - a move that would throw further doubt on the future of the currency union.

Adding to a miserable day for Spanish investors, Standard & Poor's lowered its ratings on the debt of Bankia and four other banks and said it was taking a dimmer view of Spain's economy:

"Spain is entering a double-dip recession that will likely trigger a large increase in the volume of problematic assets that the financial system will accumulate in 2012 and 2013, which in turn will lead banks record high credit provisions," the ratings agency said in its report on the banks.

BANKIA NEEDS RISE

After Bankia's new management team analyzed the financial position of the bank at a board meeting, the lender asked for 19 billion euros in state rescue money.

Earlier this week, Economy Minister Luis de Guindos, who once pledged that no public money would be used to bail out banks, told a congressional committee the state would have to put at least 9 billion euros into Bankia.

The government has already spent 4.5 billion euros to prop up Bankia, bringing the state bill up to 23.5 billion euros.

Bankia also restated its 2011 accounts on Friday to give a 3 billion euro loss compared to a previously reported profit, as it dramatically wrote down bad loans, holdings in Spanish blue-chips, and repossessed property.

One London-based analyst said the government's handling of Bankia had undermined confidence in whether the figure announced would cover losses. "Whatever they say, people are going to think it's not enough," said the analyst, who spoke on condition of anonymity. "The process has been going on for so long."

Spain is nationalizing the bank, which holds some 10 percent of the country's total deposits, after it was unable to handle heavy losses from the property bubble that burst in 2008.

The government insists that Bankia's woes do not reflect the wider financial system in Spain.

Spain will have to go to the markets to raise debt to put into Bankia at a time when its borrowing costs are high.

CATALONIA WOES

Catalonian leader Mas's comment helped to drive the euro currency to a 22-month low. Spain's country risk, as measured by the spread between German and Spanish bonds jumped to 496 basis points from around 460.

Treasury Minister Cristobal Montoro has pledged to come up with a way to back regional debt by July. On Friday, Deputy Prime Minister Soraya Saenz de Santamaria said the central government was still looking at options.

The regions have 36 billion euros of debt maturing this year and have been priced out of international bond markets. Catalonia's debt rating has been cut by S&P credit rating agency to one notch above junk.

Mas said Catalonia's options for refinancing were central government bonds or debt guarantees, high-priced short-term bank debt or the limited market for selling patriot bonds to Catalonian residents.

ADDITIONAL SPENDING

While struggling to put a precise number on a banking sector clean-up, Spain has also revised up its 2011 deficit figure several times as additional spending from regional and local governments has come to light.

The conservative government of Prime Minister Mariano Rajoy plans more than 45 billion euros in savings this year to try to bring the deficit down to 5.3 percent of GDP, a mission many say is impossible.

Spain has gone through four different stages of rescues of its banks, none of which has completely convinced investors that the clean-up has been deep enough.

Now it may end up creating one nationalized bank out of its failed lenders, including Bankia, if the state cannot find buyers for state-rescued banks like mid-sized Catalunya Caixa.

Two sources close to the situation said that the FROB bank restructuring fund, which has taken over several banks to resell them, was considering delaying the auction of Catalunya Caixa and smaller savings bank Banco de Valencia.

Under pressure from the European Union, the government has hired independent auditors to produce a report on the financial system. International institutions such as the European Central Bank and International Monetary Fund will scrutinize the audit to give it credibility.

A Catholic chaplain has been told that he cannot celebrate Mass in a South Carolina jail.

Msgr. Ed Lofton, who had been celebrating Mass at Charleston County jail for 15 years, was blocked from entering the facility because he was carrying altar wine. The jail?s policy bans all alcohol, and while state regulations in South Carolina make an exception for sacramental wine, Charleston County does not.

Msgr. Lofton reports that he bring a single ounce of wine to the jail, all of which he would consume himself. Prison officials told him that he must substitute grape juice. But a valid Mass cannot be celebrated without wine.
